The All India Muslim Personal Law Board and the Plight of Pasmanda Muslim Women: The Shah Bano Case

The All India Muslim Personal Law Board (AIMPLB), a non-governmental organization claiming to protect Sharia law, has played a significant role in the distressing situation of Pasmanda Muslim women. Supporting early marriage at the age of 15, the AIMPLB has staunchly opposed any reforms in Muslim society since its establishment in 1972. Despite presenting itself as apolitical, the AIMPLB represents the interests of the elite Ashraaf Muslims. One pivotal event illustrating this is the Shah Bano case.

In 1978, Shah Bano, a woman from Indore, won a legal battle against her husband for denying her alimony after divorcing her at the age of 62. However, the AIMPLB and a substantial portion of Muslim society vehemently opposed the Supreme Court’s ruling in her favor, claiming it contradicted Sharia law.

Succumbing to the pressure of the influential Ashraaf-led movement, the Congress government, under Rajiv Gandhi’s leadership, enacted a law to overturn the Supreme Court’s decision.
