Muslim Police Officer Wins Right to Keep Beard in Tamil Nadu

The Madras High Court has ruled in favour of a Muslim police constable, allowing him to keep his beard as a symbol of his faith. Justice L Victoria Gowri made this decision, recognizing that India is a country with many different religions and customs. The court stated that even though the police department needs to maintain strict discipline, this doesn’t mean they can punish someone from a minority community for having a beard.

The judge explained that while the Tamil Nadu police department requires discipline, this doesn’t give them the right to punish Muslim employees who keep beards throughout their lives as part of their religious beliefs.

The Case of G Abdul Khadar Ibrahim

This ruling came from a case involving G Abdul Khadar Ibrahim, who was promoted to Grade I Police Constable in 2019. He faced an investigation for two reasons: not returning to work after his 31-day leave and keeping a beard against police rules.

After the investigation, Ibrahim was punished with a pay cut for three years, later reduced to two years. He then went to court to challenge this decision.

Ibrahim argued that the authorities should have considered his religious beliefs, as keeping a beard is part of his Muslim faith. The police, however, claimed that Ibrahim was often causing problems and had been punished before for his behaviour.

Police Guidelines and Religious Accommodations

The court looked at an official memo in the Madras Police Gazette. This memo says that while officers generally can’t be permitted to have beards, Muslim police officers are allowed to keep beards throughout their careers.

Regarding Ibrahim’s late return to work, the court suggested that the police should have approved his medical leave because he had an infection after his regular leave ended.
